Claims

  1. By judgment of December 20, 2018 (I ZR 104/17, "Museumsfotos") the Bundesgerichtshof held that photographs of public-domain paintings and other two-dimensional works generally enjoy protection as photographic images under § 72 UrhG. The dispute concerned the publication on Wikimedia Commons of 17 photographs of public-domain paintings from the collection of the Reiss-Engelhorn-Museum, which the city of Mannheim runs as a municipal enterprise; the visitor had scanned some from a museum publication and taken others himself without permission. The BGH dismissed the defendant's appeal on law, upholding the OLG Stuttgart. It held that uploading the scanned images infringed the right to make the photographs publicly available that the photographer had transferred to the museum, and that by taking his own photographs during a visit the defendant breached the contractually agreed photography ban, so that the museum could demand as damages under § 280(1) and § 249 BGB that he refrain from making the images publicly available online.
